ZJAKA d.o.o. may revise these terms of use for its website at any time without notice. By using this website you are agreeing to be bound by the current version of these Terms and Conditions.

All “offers” on this website are non-binding and do not represent any binding offer for the conclusion of a contract.

The contractual party is ZJAKA d.o.o. and the second contractual party is the Buyer of the products and goods (merchandise) and festival or event ticket contained in this website or festival / event attendee.

In these Terms and Conditions, when we refer to “we“, “us” or “our“, we mean ZJAKA d.o.o. the company registered in Split, Doverska 37, Croatia. When we refer to “you” or “your“, we mean you as the Buyer or Attendee.

The products and the services you may buy in this website are: merchandise, festival or event ticket and travel packages. Buying any of these products or services, you are also agreeing to be bound by these Terms and Conditions which stand as the contract terms, differently for merchandise, festival or event ticket and travel package.

If you purchase services or products through one of the third-party websites, you will be purchasing it from the third-party and not from us so we strongly advise you to read each third-party’s terms and conditions before purchasing. We are not liable for their terms and conditions.

MERCHANDISE:

By submitting a fully completed order form, the Buyer makes the offer for the conclusion of a contract. The Buyer is bound to his/her offer for 2 weeks, which means ZJAKA d.o.o has a period of 2 weeks to accept the offer.The contract is concluded when ZJAKA d.o.o confirms the order and sends an invoice to the Buyer. If no such confirmation is given, the contract is not concluded.

The Buyer has the right to withdraw from this contract within 14 days without giving any reason by just contacting us via email. If you withdraw from this contract, we shall reimburse to you all payments received from you. We will carry out such reimbursement using the same means of payment as you used for the transaction. We may withhold reimbursement until we have received the goods back.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The Buyer has the option of returning the ordered goods within 14 days from receipt of the goods, so long as the goods are complete and undamaged. If the Buyer returns goods in accordance with this return guarantee, ZJAKA d.o.o will refund the price paid, but not the shipping costs of the original purchase.

These Terms and Conditions between the Buyer and ZJAKA d.o.o are subject to the law of the Republic of Croatia. It is agreed that the court of jurisdiction is the municipal court in Split, Croatia. If individual provisions of these Terms and Conditions and/or the contract supplemented by them are or become ineffective, the validity of the other provisions shall not be affected.

TICKETS

Festival tickets are sold via a third party (Festicket), not by ZJAKA d.o.o. The purchase contract for festival tickets is therefore concluded with this third party. The festival ticket entitles the Attendee to attend the event in accordance with the visitor contract, which is concluded with ZJAKA d.o.o. Outside of the legal withdrawal rights, legal cancellation rights or other legal contract termination rights, the Buyer has no right to return a festival ticket. You are not allowed to sell festival tickets You got via prize game, giveaway etc, yet, You can change any festival ticket name following Festicket rules. If the Buyer or/and Attendee breaches the House Rules of the event or instructions from the Organizer or security staff at the event, ZJAKA d.o.o may refuse entry and withdraw from the contract. In this case the Buyer/Attendee will not be entitled to a refund of the ticket price.

ZJAKA d.o.o. is entitled to change the event program including line-up, timetable and advertised attractions and the Buyer/Attendee will not be entitled to a refund of the ticket price.

The House Rules apply to the event that is part of the contract between the Attendee and ZJAKA d.o.o.

TRAVEL PACKAGES

Travel packages are also sold via a third party, not by ZJAKA d.o.o. The purchase contract for travel packages is therefore concluded with this third party. If you select a combination of a festival ticket, accommodation and/or transport to our festival for which you make payment together as part of one transaction, this comprises a “Travel package”. Outside of the legal withdrawal rights, legal cancellation rights or other legal contract termination rights, the Buyer has no right to return any service included in the travel package. If the Buyer or/and Attendee breaches the House Rules of the event or instructions from the Organizer or security staff at the event, ZJAKA d.o.o may refuse entry and withdraw from the contract. In this case the Buyer/Attendee will not be entitled to a refund of the travel package price.

HOUSE RULES

By accessing the festival grounds, you conform yourself to the rules below. In case these rules allow space for interpretation, the final decision will be made by ZJAKA d.o.o., members of Staff and Security.

Follow instructions of festival staff procedures in case of fire, eviction or other calamities.

You must always wear your official Festival visitors badge (bracelet) on your wrist.

Members of Staff and Security are clearly recognisable by their special badges and clothing.

Members of Staff and Security have the right to deny visitors access to festival areas in case of the following circumstances:

– disturbance of peace and safety,
– being under the influence of alcohol or drugs,
– theft,
– making a mess of the con grounds,
– vandalism,
– trespassing in areas with restricted access,
– not adhering to these house rules.

ZJAKA d.o.o. will not hesitate to contact local authorities and to claim (financial) damages on those involved. On incidents marked as illegal according to the applicable Law, a report will be made with the police. Visitors must be able to show some form of ID to Staff of Security’s request.

ZJAKA d.o.o. holds the right to deny visitors from accessing the festival without stating a reason. Paid entry fees will be reimbursed immediately. ZJAKA d.o.o. or its members are liable for additional costs, such as travel arrangements and hotel fees.

You are not allowed to sleep or take a nap anywhere inside the festival, other than in a hotel room that you are legally holding a key to. Offenders of this rule will be escorted off the premises and not allowed to return for the remainder of the festival and possibly future events for the years to come.

Throughout the festival grounds, carrying luggage like purses, bags, backpacks, coats, etc are not allowed. We only allow small lap bags (with a maximum volume of one liter), under the condition that these are worn very tight to the body at all times. Use of a notebook computer or similar equipment is not allowed on the festival grounds. Weapons (whether it be real, replica or model weapons) are strictly forbidden.

You are not allowed to bring food or drink into any room of the festival, unless stated differently. Official dealers are allowed to eat and drink at their stands, provided they keep it tidy and waste is disposed of properly.

You are not allowed to bring pets or other animals to the festival.

Members of Staff and Security hold the right to prohibit or (temporarily) confiscate prohibited objects at any time.

LEGAL CANCELLATION RIGHT

We will provide You with a refund on any unused booking if We are unable to hold the festival given to any circumstances in which case we will be entitled to charge fees and expenses paid to the third party partners.

COVID-19:

To help contain the spread of Covid-19, to protect you and manage health services, we are following guidelines, recommendations, and instructions constantly updated by the government of Croatia.

All the latest news you can find in www.koronavirus.hr website, official government website for accurate and verified information on coronavirus.

If you bought a festival ticket and the festival is rescheduled or postponed due to this pandemic, you are entitled to a refund of the festival ticket or travel package price.

We will provide you with a refund on any unused booking only if we are unable to hold the festival given to this pandemic in which case we will be entitled to charge fees and expenses paid to the third party partners. However, if the festival is scheduled as planned, we will continue to monitor the COVID-19 pandemic and inform you on the measures in force and provide you with all instructions and information.

Because of your safety, we will also be introducing:

Visible notices,
Entrance and standing plan,
Physical distancing,
Record keeping,
Face masks,
Hand-disinfection,
Measure body temperature before the arrival,
Cleaning and disinfection area.

It is strictly forbidden to attend the festival in any case if you:

Have a household member in self isolation,
Had a contact with person infected with SARS-CoV-2 in the past 14 days,
Have one of the following symptoms: high body temperature, cough, lack of air, sore throat, runny nose or loss of smell.

Considering all the measures we are taking to prevent the spread of SARS-CoV-2, any infection will be attached to your own behavior and under your own responsibility!
